Erwin Chemerinsky: You Win Some, You Lose Some

Erwin Chemerinsky, you may or may not know, is a prominent constitutional law scholar who was hired, then bizarrely fired, as the new dean for the University of California at Irvine, supposedly for being 'too liberal' to be Dean at the school in conservative Orange County. His detractors have not surfaced, as far as I know. Fellow con law profs Hugh Hewitt and Glenn Reynolds have been steadfastly supporting Chemerinsky in this odd ordeal.

Today, he was reinstated as the new dean of the law school, as he worked out a deal with Chancellor Michael Drake.

However, he lost in the Ninth Circuit Court of Appeals representing Rachel Corrie's family against Caterpillar. Corrie's family claimed that Caterpillar provided Israel with tractors "it knew would be used in violation of international law." Rachel Corrie was killed when she got in the way of a Caterpillar tractor clearing an area of explosives. The case was dismissed because the tractors were bought by the federal government and transferred to Israel, and this decision was a foreign policy "political question" that the courts cannot second-guess.

For Chemerinsky, justice was served correctly to him in both instances.

He is a patriot. Rachael corrie was murdered by a foreign government. Wars have been fought over less. Israel's "policy" is a to go absolutely ape shit and if you are in their way you're dead. That goes for rachael Corrie, beachgoers in gaza, civilians in south lebanan (qana twice 86 and 96) or the crew of the USS Liberty.

lester, Rachel Corrie was killed accidentally, she wasn't 'murdered'.

Israel is right to go ape crap against the Palestinians, who want to commit genocide against all Jews and wipe them out.

If the Palestinians would stop supporting terrorism, none of those things would happen.

yeah, qana being massacrd twice, the USS liberty and dropping shells on a beach were "accidents " too. This stuff happens at least once a year. Each time Israel denies it, saying that terrorists snuck in and planted fake bodies or shell bits in the victims, each time it is disproven, then each time the IDF investigates and absolves itself somehow.

Rachael corrie was murdered very much on purpose. They guy knew she was there and felt it was his right to run her over if she didn't get out of his way. that's what they really think of their number one benefactor. not much

Rachel Corrie was killed because she stupidly inserted herself in front of a moving tractor.
The Isrealis should sue the Corrie family for the dent on the tractor.
